TUCKER CARLSON: President Trump travelled to India last week to meet with that country’s Prime Minister, Prime Minister Modi. One of the central issues at their meeting was the H-1b visa program. that program doles out roughly 85,000 visas a year to foreigners so they can move to this country and take American jobs.

I’m not exaggerating, that’s what it does: the vast majority of these visas are given to people from India. As a candidate in 2016, Donald Trump called for ending this program entirely, but as president that hasn’t happened, though the Trump administration has made the visas slightly harder to get.

So why is the program still around? Why is it so durable? That’s an easy question to answer — it’s a favorite of tech companies which claim they simply can’t find any Americans skilled enough or smart enough to do tech work.

That’s a lie, a provable lie: companies routinely use H-1bs as a means to fire their existing American workers and replace them with lower paid foreigners. Often the fired workers are made to train their replacements before they’re terminated. The process for the replaced workers is painful and humiliating. Company executives tell them they’re being reassigned to a completely new company with a new role that consists of training people to do the job they once did. When they are not needed any more, they’re cast aside.

We recently spoke to some AT&T employees who are quote “rebadged” by the company to train cheaper replacements from India. Here’s their story:

ANONYMOUS FORMER AT&T EMPLOYEE: You’re just kind of numb. You just feel helpless, and you just accept it.

CARLSON: This former AT&T employee spent nearly two decades at the company. A few months ago AT&T informed her that she was no longer needed.

AT&T EMPLOYEE: I’m aware of at least 8,000. . .

CARLSON: Eight thousand workers?

AT&T EMPLOYEE: At least 8,000 — it could be more.

CARLSON: She is one of many former AT&T workers who found out on corporate conference calls that she was getting what they called “rebadged” to a new company where she’s forced to train a low-cost foreign replacement.

AT&T EMPLOYEE: Today it’s my job: tomorrow it could be yours.

CARLSON: She expects to be officially fired within a year.

AT&T EMPLOYEE: What can you do? Who can you call? Who do you talk to?

CARLSON: Many have turned to Sarah Blackwell, an employment lawyer who represents American workers.

SARAH BLACKWELL: What AT&T is doing is they’re firing them and having them work for the companies so they are working for AM Docs, Accenture, IBM and Tech Mahindra, and they’re training their replacements there.

CARLSON: One former employee who is currently training his replacement told us that the new workers are all from one place.

FORMER AT&T EMPLOYEE (MALE): They are all from India. Most of them are from Hyderabad; some are from Mumbai.

CARLSON: Our producers obtained shocking documents from the training courses — PowerPoint slides with the AT&T and Accenture logos inform workers about Indian cultural customs and warn that Indian men will not shake hands with American women.

FORMER AT&T EMPLOYEE: We’re an American company, and we are literally giving away our legacy. We are giving away our knowledgebase. We can’t get those things back once we outsource all this.

CARLSON: AT&T boasts about its corporate wokeness outside its corporate campus in Dallas, but the company gave it soon-to-be former employees a list of approved topics for discussion with Indian replacements and urges them not to discuss India’s human rights record or religious conflict in India with their future replacements.

BLACKWELL: Their goal is to offshore as much as it can to low-cost countries.

CARLSON: Many companies say that the foreign worker visa program helps US companies deal with the worker shortage.

BLACKWELL: You would not be firing workers if you really had a shortage.

CARLSON: Many tech companies say that the H-1b hires are smarter than Americans and better workers too. One former worker wasn’t convinced.

FORMER AT&T EMPLOYEE: Some of the folks that we work with, they are very sharp, but we’ve got some of the dumber we would have to water them twice a week.

CARLSON: AT&T for its part isn’t going broke. To give you a sense of the company’s priorities, it’s spending a hundred million dollars on an extensive renovation of its headquarters.

AT&T CEO Randall Stephenson makes nearly $30 million a year — that’s nearly 366 times the average AT&T worker. The outsourcing helps to pay for all that.

FORMER AT&T EMPLOYEE: They said you do not get a severance package: you’re not eligible for one since we found you another job. That’s what we were told. We were also told that we would not get our annual bonus next year unless we agreed to work for Accenture.

BLACKWELL: When you’re watching so many people suffer at the hands of a few getting rich and no one’s protecting them, then people will stop thinking capitalism is the right thing to do.

CARLSON PRODUCER: Do you think that the people who run the company care about the workers?

FIRST FORMER EMPLOYEE: No.

CARLSON: A spokesman for AT&T denied that any of this is happening and assured us that anyone who’s been rebadged can return to AT&T at any time.

#1 Only 1 Request for Emergency Appointment Allowed

US embassy in India is only allowing only 1 request for emergency appointment per one visa application fee. Do not use this chance if you are just giving it a try without a real emergency.

#2 Visa application fee validity increased to Dec 2021

The US embassy will allow the extension of visa application till the end of Dec 2021 keeping in view the limited appointment available due to COVID-19. This is more than the normal 1-year validity.

#3 F1 Visa Emergency Criteria

Many people and immigration lawyer Murthy have reported that even though the US embassy officially said to allow emergency appointments when a student’s session start date is less than 60 days from the date of appointment, the reality is that they are rarely allowing anyone with more than 3 weeks time.

#4 H1B, H4 – First time visa appointment after lottery

You are eligible to get an interview appointment only if you have an emergency until Mar 2021 end. This is different than the H1B travel ban.

The travel ban criteria are analyzed only once you have got a visa interview appointment and at the time of your actual interview.

#5 H1B, H4 Dropbox

H1B, H4, L1, L2 can get visa stamp processed if they are eligible for Dropbox even without proving emergency.

Dropbox Appointments are available earlier than Feb/Mar 2021 for all types of visa applications.

You can request and get approval for an emergency appointment only if you have a life and death situation or medical emergencies.

    I am sharing this if any of your family member/or yourself who is stuck in India and wants to reunite. This will be helpful for them.
    My case is that I got married in the month of February and was unable to travel to the USA because of the COVID.
    Finally, after a lot of thought, I decided to Opt for the Emergency appointment at the Mumbai Consulate for getting my visa. Normal visa processing is still shut.

    Applied for: H4 Visa

    What is an emergency situation?

    They consider family separation as an emergency situation for getting a visa.

    My case is a pure example of that and I have seen cases where they have denied also if they don’t find your reason genuine.

    My case was from Mumbai and most of the cases of family separation have been considered from (Mumbai and Delhi consulate ). It is important to select the consulate wisely.

    Hyderabad Consulates are denying EA based on family separation.

    I followed the steps as:

    1. Select the first available appointment.
    2. As soon as you schedule your appointment, you will receive a confirmation email from the consulate stating your new scheduled appointment. (In my case I could see the nearest date as Feb 17th, 2021)
    3. You will notice that there is an additional tab named Emergency request added on the left side of your screen.

    5. Once you click on EA, you need 4 things to fill in
      • Your tentative date to travel (closest to the present month, I selected 20th August)
      • Reason for Emergency – I selected Medical needs, as this caused me and my partner mental stress and anxiety.
      • A brief explanation of Emergency. I mentioned details of me getting married recently and this distance causing me mental stress and anxiety. Try writing it crisp, small, and to the point. I did not write anything about the doctor or medical condition.
      • Attachments: you can submit up to 5 attachments. (I submitted my husband’s passport, i-797, H1B visa, i94, Marriage certificate)
      • H4 visa stamping documents checklist.
    6. Submit and wait for their decision. I submitted my EA request on the 31st of July and got my EA approved on the 3rd of August. Give them 24-48 hrs to reply back.
    7. Log back into your profile when your EA is approved And select the closest OFC and consular date.
    8. NOTE: they take a Biometric and visa interview on the same date even if the OFC date is different, so please go on the date of your consular appointment.
    9. Schedule the EA appointment.
    10. Print the appointment confirmation page.

    I reached there before time but they started the visa interview late. They asked me to submit for husbands I-797, my photograph 2*2 white background, Ds -160 confirmation page, my passport at the very beginning before the interview.

    I got my visa approved. These 6 months of being separated from my family have been the worst time of my life, especially after my wedding. I hope that this write-up will help many to reunite with their families during these uncertain times.

  • The sequence of events as shared by our guest:

    Can you request emergency Appointment?

    If your H4 family is stuck in India, you can give it a try and try requesting an expedited visa processing by sharing details such as:

    • Your kid (H4) is missing school and has never attended school in India.
    • Your H4 spouse does not work in the USA – so there is no chance of affecting American worker jobs. Chances are good in this case but not guaranteed.

    Travel Ban Restrictions

    If you are trying to apply for a visa category that currently has travel restrictions like H1B, L1, J1, or their dependents, then you may not be issued a visa.
